What makes someone a sociopath?

How do I handle my ex-husband if he is a sociopath? I didn't discover this until after our divorce and we have two kids together. He uses the legal system against me and lies about everything he is very vendictive. I have all these charges on me because he had a protection order on me that was a complete lie and it is destroying me. Now I have to fight on everything with the courts all because he lied and would not allow me talk or see my kids. The reason he put it in place was so I could not contact him to make arrangement s to see my kids. His behavior got worse a year after the divorce when he knew I was in a serious relationship. He has made false allegations on members of my family, thrown me in jail four times, made threats, and controls everything. Is this because he still loves me or because he hates me for leaving him.
